This lesson covers your legal and regulatory obligations — telemarketing law, licensed-activity limits, insurance, and confidentiality. These are the rules that protect your license.
Door knocking
Section 4.8: door knocking for real estate business is not permitted unless you hold a valid Sheriff’s Card and comply with all state and local laws. You assume full responsibility for compliance.
Cold calling
Section 4.9: cold calling is prohibited unless you are fully compliant with all applicable telemarketing laws. Any cold calling must be logged, tracked, and performed only with Broker approval.
TCPA compliance
Section 4.10: you must follow the Telephone Consumer Protection Act, FCC rules, and state telemarketing law. Prohibited actions include calling numbers on the National Do Not Call Registry without documented consent; using auto-dialers, robocalls, prerecorded messages, or mass texting without prior express written consent; and contacting consumers before 8:00 a.m. or after 9:00 p.m. local time. TCPA violations carry statutory fines of $500 to $1,500 per call, text, or message, plus civil and class-action exposure. The agent is fully and solely liable — the Company carries none of it, and you indemnify the Company against any such claim.
Open houses
Section 4.11: open houses must be approved by the property’s HOA/CIC before they are held. Obtaining approval is your responsibility.
Systems and access
Section 4.12: all files, contracts, and e-signatures must be processed through Dotloop — no exceptions. Section 4.13: never share Company logins, system access, or platform credentials; this is strictly prohibited.
Transaction Coordinators
Section 4.14: only licensed Transaction Coordinators affiliated with Scofield Group may be used. The Broker may require TC usage at your expense if you show negligence or repeated file deficiencies. Per Nevada Revised Statutes and Nevada Real Estate Division regulation, you are strictly prohibited from directly paying any other licensed real estate professional — including a TC — for transaction services. All compensation to a licensed TC must flow through the Broker.
Insurance
Section 5: the Company does not provide commercial auto coverage. You must carry auto liability insurance with minimums of $100,000 per occurrence (bodily injury), $300,000 aggregate (bodily injury), and $100,000 property damage. Proof of insurance must be provided on request.
Confidentiality
Section 7: client information, including financial and personal data, must remain confidential. Company information — systems, training, contracts, databases — must not be disclosed without written consent. These obligations survive the termination of the Agreement; they do not end when your affiliation ends.
⚖️ Why this matters
Door knocking, cold calling, TCPA, Dotloop, system access, TC usage, insurance, and confidentiality protect your license. Know them before you act.
